CHICAGO — A Chicago man has been sentenced to 25 years in prison for murdering the wrong person in a botched revenge killing just days after being paroled. Justin Garmon, 33, pleaded guilty to murder in exchange for the sentence from Judge Timothy Joyce.
Garmon was released from prison on August 10, 2020, after serving half of a nine-year narcotics sentence. It was his fifth prison sentence.
Only 15 days later, Garmon allegedly set out to kill a man he thought had killed a friend, prosecutors said after his arrest. Not only was the murder caught on camera, but Garmon killed the wrong person, prosecutors alleged.
Garmon and two other men drove around in a Chevy Malibu on the afternoon of August 25, 2020, looking for the person they believed killed their mutual friend, a man they knew as “Doobie.”
When they got to the 100 block of North Mayfield, they saw 30-year-old Darry Toney walking down the street and misidentified him as the person they were trying to find, prosecutors said.
The Malibu’s driver pulled over, and Garmon got out of the front passenger seat to confront Toney, officials said. Garmon allegedly opened fire as Toney turned and walked away from him. Toney tried to run, but he collapsed. Garmon walked over and continued shooting, apparently until he ran out of ammunition, prosecutors claimed.
Detectives determined that the Malibu had been rented to the girlfriend of another man in the car, prosecutors said. When that man returned the car to her, he allegedly said, “We got the guy who killed Doobie.” But prosecutors said Doobie’s murder was also recorded on video, and Toney had nothing to do with it.
In addition to the “crystal clear” murder video, prosecutors found Garmon’s parole paperwork inside the Malibu. They also claimed Garmon posted a Facebook picture on the day of Toney’s murder that showed him wearing the same clothing as the gunman.
The Illinois Department of Corrections has not announced Garmon’s estimated parole date.
